Ocean Tomo, the Intellectual Capital Merchant Banc™ firm, undertook a study of current patent quality and historical trends among the 437 US Patent Classes as defined by the USPTO. The Ocean Tomo Patent Quality Study provides a meaningful benchmark for those studying patent quality among the 437 US Patent Classes as defined by the USPTO. The study reflects Surgery: light, thermal, and electric application (class 607) as the number one technology class for patent quality, with the highest current average OTR™ score. An average OTR™ score of 126.2 places these patents in the top 17% of all US rated patents. The top 8 technology classe, having an avergae OTR above 120, puts each among the top 24% of all rated patents.

The study was performed using the Ocean Tomo Ratings™ system the first market-validated software platform for objectively assessing patent quality, and competitive trends for patents, patent portfolios, companies, and technology sectors.The Ocean Tomo Ratings™ system uses a patented method of patent quality determination, (USP 6,556,992 7,657,476 and 7,716,226 and other US and foreign patents pending) that is statistically based calculating the relative quality of all patents issued by the U.S. Patent Office since 1976 using more than 50 independent and objective factors that are correlated to patent quality.

1.  USPC: United States Patent Classification System, a system for organizing all U.S. patent documents and many other technical documents based on common subject matter. Classes with patent count below 10 are excluded from this analysis. Based on 437 discrete US patent classes (technologies per USPTO).

2 .  Description: a detailed description of the subject matter that must be in a patent document in order for the document to be properly classified in the USPC system.

3 .  Avg OTR Score:  Average OTR issued & in-force US patents within designated USPC group. The OTR Score is the output from Ocean Tomo’s Ratings system, uses 50 independent and objective factors that are correlated to patent commercial value, where 100 is a median quality above 100 indicates above average quality relative to all issued US patents.

4 . 900 USPC is a collection of only cross-references of art. It is not a true “class” within the meaning of that term in the U.S. Patent Classification System. It is intended, however, to serve as a search tool within that system. This collection cannot receive any U.S. patent as an “original”; any document placed in this collection is to be treated as a discretionary cross-reference.
