GOOGLE’S STALKING HORSE BID – ANOTHER EXAMPLE OF BEING ONE STEP AHEAD OF THE CROWD

There are roughly 114 assets, including both issued patents and applications within the Nortel portfolio of approximately 6,000 that pertain to LTE-enabled handsets and infrastructure. The U.S. issued patents studied by Ocean Tomo (58 in total) fall into six primary classifications, with the majority in three: Multiplex Communications, Pulse or Digital Communications, and Telecommunications. The 58 issued U.S. patents are of above average quality with an average Ocean Tomo PatentRatings® IPQ® score of 127 (with 100 being average).

Ocean Tomo Announces Results of Annual Intangible Asset Market Value Study

Ocean Tomo, LLC, the nation’s premiere Intellectual Capital Merchant Banc™ firm, issued findings from its annual study of the composition of equity market value. In 2010, the implied intangible asset value of the S&P 500 reached 80%, slightly down from 81% in 2009, despite a 3.5% drop in total R&D spending among the world’s top innovators.

CAFC Opinion on  25% Rule
A Federal Circuit panel comprised of Chief Judge Rader and Circuit Judges Linn and Moore held today in Uniloc USA, Inc. v. Microsoft Corp. that:

“This court now holds as a matter of Federal Circuit law that the 25 percent rule of thumb is a fundamentally flawed tool for determining a baseline royalty rate in a hypothetical negotiation. Evidence relying on the 25 percent rule of thumb is thus inadmissible under Daubert and the Federal Rules of Evidence, because it fails to tie a reasonable royalty base to the facts of the case at issue.” (p. 41)
