Ocean Tomo, a part of J.S. Held, welcomes intellectual property (IP) expert Shelly Irvine. Ms. Irvine will lead the San Francisco office, expanding financial expert opinion, strategy consulting and transaction advisory client service on matters involving intellectual property and other intangible assets.

Ms. Irvine has testified in federal and state court related to claimed damages for patent, copyright, and trademark infringement actions on many occasions. Ms. Irvine is skilled at navigating current and evolving case law when evaluating economic damages, including the lost profits framework/ Panduit analyses, apportionment, the analytical approach, comparable licenses, and issues related to extraterritorial damages.
Ms. Irvine’s emphasis on IP-centric consulting bolsters her testifying practice by giving her practical “in the trenches” experience across many industries and technologies. Situated near Silicon Valley, Ms. Irvine has advised dozens of companies and private equity/VCs in IP strategy, valuation, and protection. Her work includes preparing business plans, benchmarking and best practices, valuation for the purposes of a buy/sell or financing event, and commercialization/value extraction strategies (including through partnerships and joint ventures). Ms. Irvine has been retained in numerous consulting engagements to develop FRAND rates for their standards-essential patent portfolios and negotiate license agreement terms.
Ms. Irvine is a member of the USC Intellectual Property Institute, ChIPs, and the Licensing Executives Society USA/Canada where she co-chairs the Internet of Things (IoT) committee. She will attend the LES USA/Canada Annual meeting taking place in San Francisco from October 16-19, 2022, and the ChIPs Annual Global Summit taking place October 26-28, 2022.
Later this month, Ms. Irvine will moderate a panel discussion during the 2022 Global FRAND & SEP Symposium. Judges, government officials, and leading professionals from three continents will explore this high-stakes topic under one roof to help participants sharpen their skills and understanding of SEP and FRAND-related issues.
